TERMS & CONDITIONS

1. General information
1.1. Viruna.lt webshop is owned by UAB VIRŪNA: Company code 134208094, address: Baldininkų g. 13, Karmėlava, 54448 Kauno r., Lithuania, tel .: (+370 37) 311143. The webshop’s (hereafter "Store") Rules (hereafter "Rules") apply to all customers aged 18 and over who live in the EU, including individual and business customers. The right of withdrawal applies only to private customers. In order to make a purchase, Buyer must agree to the store’s Terms and Conditions.
1.2. These Terms and Conditions are a valid legal document between both parties (Buyer and Seller) setting out the rights and obligations of Buyer and Seller, Terms of Purchase and Payment of Goods, Delivery and Return of Goods, Liability of the Parties and other terms related to Viruna.lt. Customer agrees to these Terms and Conditions by selecting "I have read and agree to the Terms and Conditions of Viruna.lt webshop" during a checkout.
1.2.1. The Seller reserves the right to change, amend or supplement these terms at any time, subject to the requirements of law. Purchase will be notified about any changes, corrections or additions via e-mail that was used during purchase. Buyer will be required to agree to the revised Terms and Conditions before placing a new order in Viruna.lt webshop.
1.3. The following persons or legal entities have the right to make purchases from Viruna.lt webshop:
1.3.1. natural persons who are at least 18 years old and whose legal capacity is not restricted by the court;
1.3.2. legal entities;
1.3.3. authorized representatives of all the above.
1.4. The Shop shall not be liable for any loss (material or moral) incurred in the event that the Buyer has failed to read, understand and comply with these Terms and Conditions which are publicly available on this page.

2. Protection of personal data
2.1. In order to process orders, we will be requiring you to enter some personal data during checkout (for example, but not limited to name and surname, phone number, address). Above all, we will never sell, share or use any of the personal information provided to us. This information is only used to conduct business between Seller and Buyer. Because of this, we reserve the right to share this information with delivery and payment partners in order to process the order.

3. Terms and Conditions for placing an order
3.1. The contract between the Buyer and the Seller will be in effect from the moment when Buyer, after choosing the item(s) to be purchased, clicks on the "Pay now" or “Confirm order” link.
3.2. Each purchase and sale contract between Buyer and Seller is registered and stored in Viruna.lt webshop’s online database.

4. Buyer Rights
4.1. The Buyer has the right to purchase the goods in Viruna.lt online shop in accordance with the procedure established by these Terms and Conditions and the online store.
4.2. The Buyer shall have the right to withdraw from the contract of sale and purchase of goods by notifying the Seller in written form (by e-mail, indicating the desired item to be returned and its order number) no later than 14 (fourteen) calendar days from the day of delivery.
4.3. The goods must be returned to the following address: UAB Viruna, Baldininkų g. 13, Karmėlava, LT-54448 Kaunas District). For more information, contact us via Contact page.
4.4. Point 4.2. only applies if the items which have not been used, damaged and have not lost its original appearance.

5. Buyer obligations
5.1. The Buyer must pay for the goods and accept them in accordance with the procedure established in these Rules.
5.2. The Buyer undertakes not to give his/her account’s login details to third parties. If the Buyer loses the login details, he/she must immediately inform the Seller by the means of communication specified in the "Contact" section.

6. Seller’s rights
6.1. The Seller has the right to determine the minimum size of the shopping cart, i.e. the minimum amount or price of products at which the Buyer's order will be executed. This information is visible when viewing the shopping cart.
6.2. If the Buyer attempts to compromise the stability or security of the webshop or violates its obligations, the Seller has the right to immediately and without notice restrict or suspend its use of the webshop or, in rare cases, cancel the registration of the Buyer.
6.3. In the event of serious circumstances, the Seller may suspend or terminate the webshop without giving prior notice to the Buyer.
6.4. The Seller has the right to cancel order without prior notice to the Buyer, if the order has not been paid in 3 days after it’s placed.

7. Seller's obligations
7.1. The Seller undertakes to provide the Buyer with access to the services provided by Viruna.lt webshop under the terms and conditions set out in these Terms and Conditions and in the webshop.
7.2. Seller undertakes to respect Customer's privacy by securely handling the information entered during checkout or registration process. Seller does not share this information with third parties, except in cases where it’s required to fulfill the order. Examples include, but may not be limited to logistics and payment vendors.
7.3. The Seller undertakes to deliver the ordered goods to the address specified by the Buyer, following the conditions specified in point 9 of these Terms and Conditions.
7.4. If the Seller is unable to deliver the ordered product to the Buyer due to special circumstances, it undertakes to offer an analogue product or product that is as similar as possible. If the Buyer refuses to accept analogue or similar product, the Seller undertakes to return the money paid to the Buyer within 14 business days. This only applies when the prepayment has been made.

8. Product prices, payment terms and other terms
8.1. The prices of goods in webshop and on prepayment invoices are quoted in euros, including VAT.
8.2. The Buyer shall pay for the goods in one of the following ways:
8.2.1. By credit or debit card (Visa, Visa Electron, MasterCard). This is fast, secure and safe payment method, which will take up to few minutes to process until the payment is cleared.
8.2.2. Paypal payment system. This payment method may be slower and depending on bank used, may include a service fee.
8.2.3 Bank transfer according to Advance invoice. Your order will be confirmed only after payment has arrived in our bank account. Depending on bank, it could take up to 2-3 working days, but usually 1 workday.
8.3. By settlement 8.2.1. and 8.2.2. The Customer undertakes to pay for the Goods immediately during checkout process. Subject to the Seller's rights set forth in clause 6.4. The order will not be executed until the money is received. Delivery could also be delayed if it happens that payment is delayed for reasons beyond our control.

9. Delivery of goods
9.1. The Buyer undertakes to indicate the place of delivery when ordering the goods.
9.2. The Buyer undertakes to accept the goods himself. In the event that he can not accept the goods himself and the goods have been delivered to the specified address on the basis of data provided by the Buyer, the Buyer shall not be entitled to make claims against the Seller regarding delivery of the goods to an unsuitable entity/time/address.
9.3. The goods will be delivered by the Seller’s authorized representative.
9.4. All orders will be shipped within the time specified on the order form. In some cases, Buyer will be notified by separate notice. This can happen i.e when client has made a custom order or the order can not be delivered in advertised timeframe. All orders are delivered via courier service. The courier tries to deliver the order up to 2 times before it is returned to the sender.
9.4.1. Delivery price starts from 5 EUR and varies between countries. Shipping cost may also vary depending on weight and size of the ordered goods. Specific shipping price will be calculated separately for each order.
9.4.2. As soon as order is shipped out, Buyer will get a tracking code.
9.4.3. Business customers will receive the parcel at the address specified in the order, so be careful when entering the address. The address you enter may or may not be a business address.
9.5. The Seller is not responsible for delivery delays caused by the delivery service provider or the customer.
9.6. At the time of delivery, the condition of the delivered goods must be checked by Buyer and Seller’s authorized representative. When Buyer gets a receipt (delivery note) or other delivery document from the courier, the shipment shall be deemed to have been delivered in the proper condition. Upon noticing that the shipment package is damaged (wrinkled, wet or otherwise externally damaged), the Buyer must mark it on the invoice (bill of lading) or other delivery document. This must be done together with Seller’s representative. If, for some reason, the Buyer did not perform such actions, the Seller is being relieved from liability to the Buyer in case the goods are damaged because of broken/damaged package.

10. Product warranty and other terms
10.1. All product properties are listed in the description of each product.
10.2. The Seller shall not be liable if the color, shape or other characteristics of the product are different from real world product, because of the customer's monitor / screen.
10.3. The Seller may provide a limited warranty for certain products or parts. In this case, the specific warranty terms and conditions are specified in the product description.

11. Product returns and replacements
11.1. Customer has the option to return or replace products. To do so, he must complete a return form (either electronically or physically) and send it together with returned products.
11.2. Return or exchange must take place during 14 days after the product is received. For returning or exchanging product, Buyer must contact Seller in accordance with point 4.2.
11.3. The following conditions must be met when returning the goods:
11.3.1. the item to be returned must be in its original, undamaged packaging;
11.3.2. the item must be undamaged by the Buyer;
11.3.3. the item must not have lost its marketable appearance (intact labels, tear film, etc.). This does not apply in case the returned product is defective;
11.3.4. set products must be returned as a whole. There is no possibility to return only part of the set, when set itself consists of multiple products. This does not apply to defective products.
11.3.5. when returning the item it is necessary to present the document of purchase, a guarantee voucher (if it has been issued) and the filled return form from us, Virunas.lt.
11.3. The Seller shall have the right not to accept the goods returned by the Buyer, if the Buyer does not follow the above rules.
11.5. If the customer wishes to return the products under clause 4.2. the Seller will not cover the cost of the return. Seller will only cover return related quest when the received item is faulty or defective.

12. Liability
12.1. The Buyer is fully responsible for the data provided in the registration/checkout form. If the Buyer fails to provide accurate data in the registration form, the Seller shall not be liable for any consequences thereof.
12.2. If the Buyer has registered account, he is fully responsible for all the actions taken through the account.
12.3. The Buyer is responsible not to reveal his login data to third parties. If the services provided by Viruna.lt are used by a third party, who logs into Buyer’s account, the Seller shall treat that person as the Buyer.
12.4. The Seller shall be relieved of any liability in cases where the loss arises from the fact that the Buyer, without regard to the Seller's recommendations and his obligations, has not become acquainted with these Terms, even though he has been given such opportunity.
12.5. If the Seller's webshop contains links to websites of other companies, institutions, organizations or individuals, then the Seller is not responsible for information presented in those websites. The Seller does not maintain, control, or represent those companies or individuals.

13. Marketing by the Seller
13.1. The Seller may initiate various promotions in the Viruna.lt webshop.
13.2. The Seller has the right to unilaterally change these Terms and Conditions without notice, as well as cancel them.
13.3. The Buyer has the opportunity to subscribe to a newsletter, which contains various offers and other information about the product. At any given time, he can also unsubscribe from these newsletters.

14. Exchange of information
14.1. The Seller shall send all notifications and information to the email address provided in the Buyer’s registration/checkout form.
14.2. The Buyer shall send all notices and inquiries by the means of communication specified in the "Contacts" section of the Seller's webshop.

15. Final Provisions
15.1. The contract is made, executed and all communication between the customer and the shop is carried out in English language.
